Oklahoma Hard Money and Investor Loans

Oklahoma is a law-heavy state to close in, and we underwrite it that way.

USA Mortgage funds investors across Oklahoma. This page is about the rules you close under here: judicial foreclosure with an opt-in power of sale, two separate transaction taxes, and a title file that runs through an abstractor and an attorney. For what the market is doing, go to the metro pages. Business-purpose loans only, and every structure is set in underwriting.

Oklahoma lending questions

Do you lend across all of Oklahoma?
Yes. We fund business-purpose loans on non-owner-occupied property statewide, and we have Oklahoma City and Tulsa pages for what those markets are actually doing. The state layer is what changes your file, not your zip code: Oklahoma forecloses judicially by default, charges both a deed stamp and a mortgage registration tax, and requires an abstract and an attorney examination underneath any title policy. Our loans are business-purpose only, on investment property, and terms are subject to underwriting. See loan programs or talk to us.
Is Oklahoma a judicial or a non-judicial foreclosure state?
Both, and the order matters. Judicial foreclosure through the district court is the default. A power of sale is available only if the mortgage grants one under the Oklahoma Power of Sale Mortgage Foreclosure Act at title 46 sections 40 to 49, and only if the mortgage carries the bold, underlined legend that section 43 requires, word for word. From there the statute sets the clock: a 35-day notice of intention to foreclose by certified mail under section 44, then a notice of sale that must be personally served at least 30 days before the sale and published once a week for four consecutive weeks under section 45. One more thing an out-of-state lender should know: a homestead borrower can force the whole thing back into court with 10 days' certified-mail notice plus a recorded copy. None of that homestead machinery reaches an LLC-owned rental, which is a structural reason business-purpose lending here is written on non-owner-occupied collateral. Confirm your own position with Oklahoma counsel.
What does it cost to record a purchase and a mortgage in Oklahoma?
Less than most people expect, because Oklahoma charges two small taxes rather than one large one. The documentary stamp tax under title 68 section 3201 runs 75 cents per $500 of consideration, which is 0.15% of price, so a $300,000 purchase carries $450 in stamps (300,000 / 500 = 600, x $0.75 = $450). The mortgage registration tax under title 68 section 1904 is scaled to the term of the note: 0.02% under two years, 0.04% at two to three years, 0.06% at three to four, 0.08% at four to five, and 0.10% at five years or more, plus a $10 county treasurer certification fee. Recording is a flat $8 for the first page and $2 per additional page statewide, plus $10 per instrument for records preservation. Two things to keep on the checklist: assumed debt counts as consideration for the stamp, and an unrecorded mortgage tax blocks foreclosure under section 1907.
Why do Oklahoma closings take longer than the ones I do in other states?
Because of the abstract. Title 36 section 5001(C) says no title commitment or policy may issue in Oklahoma until an attorney licensed here examines a certified abstract, or a certified extension of one, prepared by an abstractor licensed in the county where the property sits. It is worth being precise about this, because the common description is wrong: Oklahoma is not a state where you choose between an abstract opinion and a title policy. The abstract and the attorney examination sit underneath the policy. That puts the county abstract plant on the critical path for every deal, which is the main reason Oklahoma closings get quoted in weeks rather than days. We do not publish an abstracting turnaround or a cost, because there is no source we would stand behind. Ask your closer for the county-specific number early, not the week you need to fund.
How does Oklahoma property tax work on investment property?
Differently from the states most investors compare it to. Oklahoma assesses real property at a fraction of fair cash value, between 11% and 13.5%, set county by county under article 10 section 8 of the state constitution. For tax year 2024 both core metro counties sat at the floor: Oklahoma County 11.00% and Tulsa County 11.00%, while Cleveland and Canadian counties were at 12.00%. That is the real regional spread here. An identical building in a fast-growing suburban county is assessed on about 9% more of its value before a single mill is applied, so a Norman or Yukon deal does not pencil like an Oklahoma City deal even at the same price. Then there is the cap: article 10 section 8B limits any increase in fair cash value to 5% a year on all locally assessed real property, not just homesteads. The catch is that the cap resets on transfer and on improvement, so it rewards a long hold and does nothing for a flip or a heavy value-add. Local millage is a metro question. Oklahoma City and Tulsa cover their own numbers.
When do I have to protest an Oklahoma assessment?
Fast, and the clock runs from a mailing date rather than from the day you open the envelope. Under title 68 section 2876, an increase notice gives you 30 calendar days from the date the notice was mailed to file a written protest with the county assessor on the form the Tax Commission prescribes. If your value did not change but you still think it is wrong, you may protest on or before the first Monday in April. File the section 2835 form with the protest as well. Skipping it creates a presumption in favor of the assessor's value on appeal, which is an avoidable own goal. After the informal hearing you get a written decision within 7 days and 15 calendar days from that mailing to appeal to the county board of equalization. Put both dates on the calendar the day the notice arrives.
What state taxes will my Oklahoma rental income face?
Lower than they were, and moving. The individual top rate is 4.5% for tax year 2026 under title 68 section 2355(D), down from the 4.75% that applied in 2024 and 2025, so any article quoting 4.75% is describing last year. The statute also sets a trigger-based path toward zero: each time the Board of Equalization certifies that collections clear a statutory threshold, every rate drops by a quarter point, and a declared revenue failure suspends the cut. That is a path, not a repeal. Corporate income tax is 4%, and the corporate franchise tax was repealed for tax year 2024 forward. If you are an out-of-state member of an Oklahoma LLC, note that a pass-through entity must withhold at the highest individual rate on your share and make quarterly estimates once expected withholding exceeds $500. Talk to your Oklahoma CPA about your own position.
What credit score do I need to borrow in Oklahoma?
It depends on the program, not on the state. On our asset-based loans, meaning fix and flip, bridge, and ground up construction, there is no minimum score. We run credit, but it carries far less weight than it would at a bank, and weaker credit is usually answered with lower leverage rather than a decline. DSCR and bank statement loans start at 640, conventional investment starts at 580, and transactional funding runs with no credit check at all. There is no hard pull to open an Oklahoma file. Subject to underwriting.
What is the smallest loan you will write in Oklahoma?
$100,000 on most residential programs. Fix and flip, DSCR, and bank statement loans all start there. Portfolio loans start at $500,000 across five or more properties, and SBA starts at $350,000. At the top, fix and flip and construction run to $5,000,000, DSCR and bank statement to $3,000,000, and commercial bridge to $10,000,000. Oklahoma has real inventory under the $100,000 floor, so check the number before you tie up a contract. Subject to underwriting.

About the local figures on this page

Local rules move. Every tax rate, fee, ordinance and market figure here comes from a primary source and carries the date we read it, and we correct them as the rules change. Where a number is mid-change or we could not verify it, we say so rather than guess. Before you commit a budget, confirm anything that drives it with the city or county, and talk to your attorney or CPA on questions of law or tax.

Published by USA Mortgage Funding, LLC, NMLS #152588. Researched from primary sources by our team, drafted with AI assistance, and every figure checked against its source before publishing. Where an answer rests on a public record, that record is linked under it. Figures read on 2026-08-12.
