Do I need a Missouri mortgage license to borrow for an investment property?
No, because a business-purpose loan to an LLC on non-owner-occupied property is not a "residential mortgage loan" under Missouri law. RSMo 443.703(30) defines that term as a loan primarily for personal, family, or household use, and the older definition at RSMo 443.803.1(20) additionally limits it to a loan to a natural person. A DSCR or fix-and-flip loan to an entity, on a rental, fails the purpose element under both definitions and the natural-person element under the second, so it sits outside the licensing sections rather than inside an exemption to them. Missouri's Division of Finance has not published guidance confirming that reading, so it rests on the statutory text alone and your own structure is worth confirming with Missouri counsel. Is Missouri a judicial or a non-judicial foreclosure state?
Non-judicial. Missouri forecloses through a trustee's sale under a deed of trust, and RSMo 443.310 requires not less than twenty days' notice of the sale, in the county where the property sits. There is one wrinkle worth knowing before anyone repeats the common myth: RSMo 443.410 gives the grantor a one-year post-sale redemption right, but only where the lender or its nominee buys at the sale on a credit bid, the grantor gave written notice before the sale, and the grantor posts a court-approved bond within twenty days after it. A sale to an unrelated third-party bidder carries no such right. Missouri does not have "no redemption" after a trustee's sale, and a lender disposing of Missouri REO should plan around it. What does closing cost in Missouri transfer and recording taxes?
No transfer tax at all, on either the purchase or the exit. Missouri Constitution article X section 25 bars the state, counties, and every other political subdivision from imposing any new tax on the sale or transfer of real estate, at any level, permanently. That is a structural difference from neighboring Illinois and Kansas, both of which do charge one. Recording is a flat statutory base under RSMo 59.310, five dollars for the first page and three dollars per page after that, though counties add their own surcharges on top, so ask the recorder for the current county total before closing. No statewide mortgage registration or mortgage recording tax was located either.
How does Missouri usury law treat a business-purpose loan?
Missouri lets the parties set their own rate in writing, and a business-purpose entity loan clears that carve-out three separate ways. RSMo 408.030 caps interest at ten percent unless the market rate exceeds it, and sets real penalties for overcharging a covered borrower. RSMo 408.035 removes that cap entirely for a loan to a corporation, partnership, or limited liability company, for an extension of credit for business or commercial purposes, or for a real estate loan other than a residential one. A USAM loan to a Missouri LLC for business purposes on an investment property satisfies more than one of those prongs, so long as the terms are set down in writing. It is an individual borrower on a personal-purpose home loan that stays inside the cap, not an entity investor.
